Abstract

The implementation of night shifts toward female workers is studied by the researcher to know it’s effectiveness based on Article 76 of Law Number 13 of 2003 regarding Employment Law in Indonesia. This study reviews the Indonesian Employment Law using a socio-legal approach or socio-legal study method, employing data collection techniques such as interviews, documentation, and data analysis. The conclusions and recommendations of this writing highlight the widespread lack of awareness among female workers regarding the protection provided for nighttime workers, as stated in Article 76 of Law Number 13 of 2003 regarding Employment Law in Indonesia. Field observations reveal that both female workers and employers' lack of awareness leads to a mismatch between the provisions of the law and its practical implementation, particularly concerning the rights that should be granted to female workers working night shifts. Unfortunately, these rights have not been fully granted by employers to the employees. The law supposed to be able to serve as a foundation and a means to facilitate this, and the government should conduct a review of employment laws to clarify and strengthen the protection for female night shift workers.
