Abstract
This study on the implementation grant leave of absence before the Commons, as stipulated in Government Regulation Number 32 Year 1999 on Terms and Procedures for Implementation of Citizen Rights jo Patronage Penitentiary. Candy Law and Human Rights No. M.01.PK.04.10 Year 2007 on Terms and Procedures on the Implementation of Assimilation, Parole, Furlough Towards Free, and Conditional Furlough. Issues raised in this research about how the implementation of grant free to leave ahead of inmates in correctional institutions Klas IIB Lumajang, what are the bottlenecks in the implementation grant leave of absence before the Commons for inmates in correctional institutions Lumajang Klas IIB, and what efforts done to overcome the obstacles in the implementation grant leave of absence before the Commons for inmates in correctional institutions Lumajang Klas IIB. This study uses sociological juridical approach, the location of the research conducted at the Correctional Institution Lumajang Klas IIB, data sources using primary data and secondary data, data collection techniques such as library research, interviews with respondents who came from officers and inmates, who are in prisons Klas IIB Lumajang and also the prisoners as the primary data collection, and then analyzed by descriptive qualitative. Based on the research and discussion that the implementation of grant free to leave ahead of inmates in prisons Klas IIB Lumajang not effective, because it felt still complicated with lengthy procedural, so that hinder the smooth implementation of the right to leave the program before the Commons, and the measures taken is to provide information and explanations regarding the right freely to leave ahead of the inmates, and providing an alternative to alleviate the procedural legislation. To be able to help towards a better improvement, the need for encouragement and support from the government in order to alleviate the procedural filing free menejelang leave rights, and find other alternatives to avoid obstacles regarding the implementation process towards the free provision of such leave rights.
