Integrasi PTUN ke dalam Peradilan Umum dari Perspektif Sistem Peradilan di Indonesia

This study is motivated by various structural issues still faced by the Administrative Court (PTUN) in providing effective legal protection to the public. The limited number of PTUN courts, uneven institutional distribution, high costs of accessing the courts, limited jurisdiction over certain government actions, and low effectiveness in enforcing court decisions are factors that hinder the realization of optimal access to justice. The research questions in this study concern the urgency of integrating the Administrative Court into the General Court system in Indonesia and what the ideal concept of such integration looks like from a judicial system perspective. The research method employed is normative legal research using legislative, conceptual, and comparative approaches. Legal materials were collected through a literature review and analyzed using a prescriptive-qualitative approach. The research findings indicate that the integration of the Administrative Court (PTUN) into the General Court System is urgently needed to expand access to justice, improve institutional efficiency, reduce the fragmentation of judicial authority, and strengthen legal protection for citizens against government actions. The ideal concept of integration involves establishing a special chamber or panel for administrative matters within the General Court system while maintaining the specialization of administrative judges, updating procedural laws, and strengthening oversight mechanisms by the Supreme Court. The recommendation of this study is the need to reformulate the administrative justice system through the integration of the Administrative Court (PTUN) into the General Court system while maintaining the specialized jurisdiction of administrative judges in order to realize a judicial system that is more effective, efficient, and oriented toward the interests of those seeking justice.
