IMPLEMENTASI KEADILAN RESTORATIF DALAM PENANGANAN TINDAK PIDANA PENYALAHGUNAAN NARKOTIKA UNTUK DIRI SENDIRI (Studi di Kepolisian Resor Malang)

The increasing percentage of drug abuse cases resolved through restorative justice indicates a paradigm shift in treatment from a repressive approach to a restorative justice approach. Drug abusers, under certain circumstances, are positioned not only as perpetrators of crimes but also as victims in need of rehabilitation. This study aims to determine and analyze the implementation of restorative justice in handling self-inflicted drug abuse at the Malang Police Department and to identify the obstacles encountered in its implementation. The research method used is a sociological juridical approach with an empirical approach. Data collection techniques include interviews and document studies, and descriptive qualitative data analysis techniques. The results of this study indicate that the implementation of restorative justice is carried out through the stages of perpetrator classification, fulfilling the requirements stipulated in Police Regulation Number 8 of 2021, and conducting an assessment to determine eligibility for rehabilitation. However, obstacles remain, including ambiguity in perpetrator classification and the suspect's lack of cooperation during the investigation phase. The conclusion and recommendations of this study are that the implementation of restorative justice at the Malang Police Resort reflects restorative values, but its implementation is not yet fully optimal. Therefore, strengthening legal certainty and supporting facilities are still needed for consistent and effective implementation.
