Abstract

This study aims to analyze the legal status of virtual land as a digital investment object from the perspective of Indonesian civil law and to examine the urgency of establishing specific legal regulations governing virtual land in order to provide
legal certainty and legal protection for parties involved in digital asset transactions. The research employs a normative juridical method using both statutory and conceptual approaches. The legal materials consist of primary, secondary, and tertiary legal sources, which are analyzed qualitatively through a deductive method. The results of the study indicate that virtual land cannot be classified as an object of land rights as regulated under the Basic Agrarian Law because it lacks physical form and does not exist within the geographical territory of the state. However, from the perspective of civil law, virtual land may be
classified as an intangible movable property as contemplated under Article 499 of the Indonesian Civil Code, as it possesses economic value, can be owned, and can be transferred through digital transactions. Furthermore, there are currently no
specific regulations in Indonesia governing virtual land as a form of digital investment. Regulations issued by the Financial Services Authority (OJK) only govern digital financial assets, including crypto assets, and therefore do not encompass virtual land. This situation creates a legal vacuum that results in legal
uncertainty for pemilik tanah virtual (virtual land)s. Therefore, the establishment of specific regulations is necessary to provide legal certainty and legal protection for virtual land investment activities in Indonesia.
