ANALISIS FATWA MAJELIS ULAMA INDONESIA NOMOR83 TAHUN2023 TENTANG PEMBOIKOTAN TERHADAP PRODUK AFILIASI ISRAEL DI TINJAU DARI PERSPEKTIF MASLAHAH MURSALAH

The intensity of Israeli aggression against the Palestinian people continues to escalate and persist to this day. This situation has elicited responses from various parties worldwide, ranging from human rights organizations and the United Nations to religious institutions. One such institution is the Indonesian Ulema Council (MUI), which responded by issuing a fatwa regarding the boycott of products affiliated with Israel. Employing a conceptual approach, this study analyzes the MUI fatwa on boycotting Israel-affiliated products through the lens of *maslahah mursalah* (public interest not explicitly addressed by scripture). By referencing the views of the various schools of jurisprudence (*madhhabs*) regarding the concept of legal derivation (*istinbat*), this research aims to elucidate the concept of *maslahah mursalah* as a method of *ijtihad* (independent legal reasoning) and its application in resolving legal issues. The study argues that not all schools of jurisprudence utilize *maslahah mursalah* when addressing issues of Islamic law. Some imams explicitly acknowledge and employ *maslahah mursalah* as a method of *ijtihad*; others do not formally acknowledge it yet maintain a substantive alignment with their standard *ijtihad* methods; while others neither acknowledge nor apply it at all.
