Abstract

People with disabilities are part of a diverse society that has constitutional rights as citizens. However, due to their specificity, this group often receives discriminatory actions even when they become victims of sexual violence. For this reason, this research will further examine the fulfillment of access to justice for victims of sexual violence with disabilities, especially when viewed from Article 6 of the Government Regulation on Reasonable Accommodation. By using a socio-legal approach, this research will focus on the work of the Sentra Advokasi Perempuan, Difabel dan Anak (SAPDA) institution as a legal assistance institution that assists victims during the process at the judicial institution. This research aims to build an understanding of the access to justice that must be fulfilled by the state and law enforcement agencies for victims of disability. The results of this study indicate that the fulfillment of proper accommodation for victims of sexual violence with disabilities is still not running optimally. Some of the main factors are the lack of APH perspectives and the existence of a legal vacuum and disharmony of laws and regulations. For this reason, it is necessary to strengthen law enforcement officers through mainstreaming disability and improving regulations. So that in the end it can realize an inclusive justice system.
