Abstract

The proliferation of social media has triggered an escalation in the spread of pornographic content, necessitating technology-based procedural law enforcement by the police. This research at the Malang City Police Resort aims to analyze the investigation process and collection of electronic evidence, as well as identify factual obstacles in the field. The method used is empirical legal research with a juridical-sociological approach and qualitative descriptive analysis. The research results and conclusions indicate that the investigation process is running optimally through the Scientific Crime Investigation method (digital forensics) based on the lex specialis of the ITE Law to prove the element of malicious intent (mens rea) and maintain the integrity of the digital trail (chain of custody). However, the effectiveness of this law enforcement is reduced by technical obstacles such as the use of anonymous identities by perpetrators, as well as sociological obstacles such as the phenomenon of "viral culture" and victim blaming, which disrupt the security of electronic evidence and trigger further trauma for victims. Therefore, it is recommended to strengthen digital forensic infrastructure within the police force, tighten the cross-sectoral National Identity Number (NIK) registration system, and increase public legal literacy to curb the habit of viralizing cases of indecency and prevent secondary victimization.
