Abstract

The traditional ferry boat (perahu tambangan) is one of the river crossing transportation modes that remains actively operating along the Brantas River in Tulungagung Regency. Its existence plays a strategic role in supporting the mobility of communities residing along the riverbanks. One of the ferry boats operating in the area is the "Rizki Barokah" ferry owned by Mr. Nur Kholis, located in Pundensari Hamlet, Rejotangan District, Tulungagung Regency. This ferry boat operates without an operational license and river transport certification as required by regulations, thereby raising serious concerns regarding the fulfillment of passenger safety and security standards. This study aims to examine how safety and security standards are fulfilled for passengers of the ferry boat operating without an operational license on the Brantas River in Pundensari Hamlet, Rejotangan District, Tulungagung Regency. The research method employed is socio-legal research with data collection through interviews and documentation. The findings indicate that the "Rizki Barokah" ferry boat has not fulfilled the legality requirements as stipulated in Article 27 paragraph (1) of Law Number 17 of 2008 concerning Shipping. The fulfillment of safety standards has also not been implemented optimally, as reflected in the non-use of life jackets during crossings, the absence of crew certification, reactive maintenance practices, and load capacity determination based solely on the operator's subjective assessment. These conditions indicate a gap between normative provisions and the actual practice of river transport operations that potentially threatens passenger safety.
