Abstract

Drug abuse in Indonesia remains a serious issue, including in Batu City, where the number of users increased from 2023 to 2024. Law Number 35 of 2009 concerning Narcotics, particularly Article 54, stipulates that narcotics addicts and victims of drug abuse are required to undergo medical and social rehabilitation. This provision reflects a shift from a repressive approach toward a rehabilitative approach. This study aims to analyze the implementation of medical and social rehabilitation for narcotics addicts at BNN Batu City and to identify the obstacles encountered in its implementation. This research applies an empirical juridical method with a statutory approach. Data were collected through interviews, observations, and literature studies, and analyzed qualitatively. The results show that BNN Batu City has implemented rehabilitation in accordance with Article 54
of Law Number 35 of 2009 through an outpatient rehabilitation program, which includes assessment, medical rehabilitation, social rehabilitation, and follow-up monitoring. However, several obstacles remain, such as social stigma toward drug addicts, low awareness of self-reporting, refusal to undergo rehabilitation, and limited public understanding regarding the right to rehabilitation. In conclusion,
the implementation of rehabilitation at BNN Batu City normatively aligns with existing legal regulations. Nevertheless, practical improvements are still needed, particularly in public socialization, inter-agency coordination, and the development of legal awareness within society to ensure that rehabilitation objectives can be optimally achieved.
