Peran Kepolisian Dalam Memberikan Perlindungan Khusus Terhadap Anak Berkonflik Dengan Hukum Tindak Pidana Pembunuhan (Studi Kasus Di Kepolisian Resor Mojokerto Kota)

This study aims to analyze the role of investigators in handling Children in Conflict with the Law (ABH) as perpetrators of murder crimes under special protection in the police, as well as to identify factors that become obstacles in the process of disclosure and evidence. The research method used is empirical juridical with a statutory regulatory approach and a case approach, through an analysis of investigative practices in murder cases involving children in the jurisdiction of the Mojokerto City Police in 2023. The results of the study indicate that the role of investigators is carried out through the application of legitimate investigative procedures in accordance with the Criminal Procedure Code and Law Number 11 of 2012 concerning the Juvenile Criminal Justice System, emphasizing the protection of children's rights, legal assistance, individual assessments, legal management of evidence, and cross-institutional coordination. Investigations are not only oriented towards revealing material truth, but also on protecting the best interests of children through a humanist and accountable approach. Obstacles faced by investigators include limited human resources with special competencies in handling children, the complexity of evidence due to the condition of the evidence, and procedural limitations inherent in the principles of child protection. Nevertheless, the application of the principles of professionalism, prudence, and institutional coordination allows the investigation process to proceed effectively and in accordance with applicable legal provisions.
