Abstract
Drug abuse by individuals for personal use remains a serious issue within the Indonesian criminal justice system, particularly as indicated by the high rate of recidivism. The correctional system, which is oriented toward guidance, rehabilitation, and social reintegration, is expected to reduce the recurrence of narcotics-related offenses. This study aims to analyze the implementation of guidance and rehabilitation programs for recidivist inmates convicted of narcotics abuse for personal use from the perspective of the correctional system, as well as to identify the obstacles faced in their implementation at Class IIB Jombang Correctional Institution.
This research employs an empirical legal research method with a socio-juridical approach. Data were obtained through interviews with recidivist narcotics inmates and correctional officers, supported by literature studies on relevant laws and regulations as well as scientific references. Data analysis was conducted using Soerjono Soekanto’s theory of law implementation. The results indicate that the implementation of guidance and rehabilitation programs at the Class IIB Jombang Correctional Institution, as a general correctional facility, has been carried out in a structured manner. However, it remains general in nature and has not been differentiated, where the treatment of narcotics inmates tends to be equated with that of general inmates, and no distinction is made between recidivist and non-recidivist inmates in the implementation of such programs. The obstacles identified include limited facilities and infrastructure as well as the absence of medical rehabilitation
programs, which consequently affect the suboptimal prevention of narcotics recidivism.
