Abstract

This study aims to analyze the phenomenon of children as street vendors from the perspective of Child Protection Law and the concept of ḥifẓ al-nasl within maqāṣid al-sharīʿah. This research employs a normative legal research method using statutory and conceptual approaches. The data sources consist of primary, secondary, and tertiary legal materials, analyzed using a descriptive-analytical method.
The results indicate that the phenomenon of children as street vendors is influenced by socio-economic factors, particularly poverty, low parental education levels, and weak supervision and law enforcement. From the perspective of Child Protection Law, children’s involvement in street vending can be categorized as economic exploitation if it disrupts education, endangers safety, and hinders child development. Meanwhile, from the perspective of ḥifẓ al-nasl, such practices contradict the objectives of Islamic law in preserving progeny, as they threaten not only the physical safety of children but also their moral, educational, and social development.
Therefore, this phenomenon is a multidimensional issue that requires an integrative approach between positive law and Islamic values. Child protection efforts must be carried out comprehensively through strengthening law enforcement, increasing family awareness, and providing social and economic support for communities.
