Abstract

This study aims to analyze the misuse of personal data in fictitious credit applications
committed by an employee of PT. X Mojokerto Branch and to examine its legal
settlement under civil law. The research problems are: first, how personal data was
misused in fictitious credit applications by an employee of PT. X Mojokerto; second,
how the legal settlement of such misuse was carried out. This research applies a
juridical-empirical method with a descriptive qualitative approach. Data were collected
through interviews, documentation studies, and analysis of relevant regulations,
particularly the Indonesian Civil Code and Law Number 27 of 2022 concerning
Personal Data Protection. The results indicate that the use of personal data without the
owner’s consent does not fulfill the objective requirements of a valid contract under
Article 1320 of the Indonesian Civil Code. Consequently, the credit agreement is null
and void and does not create legally binding obligations for the victims. The act also
constitutes an unlawful act under Article 1365 of the Indonesian Civil Code. The
dispute was resolved through non-litigation mechanisms, namely mediation and
negotiation, resulting in a settlement agreement that included cancellation of the credit,
elimination of debt obligations, and restoration of the victims’ reputation. This study
recommends that financing companies strengthen internal supervision and data
verification systems to prevent similar incidents in the future.
