Abstract
This study thoroughly examines the implementation of royalty payment obligations for the use of musical works in commercial radio broadcasting, specifically based on the provisions of Article 87 of Law Number 28 of 2014 concerning Copyright, with a focus on Radio VIS FM Banyuwangi. The research centers on the integration between the copyright legal regime protecting the economic rights of creators and the broadcasting legal regime governing the management of the national broadcasting system, whereby commercial radio broadcasters bear a legal responsibility to fulfill royalty obligations. This study employs empirical legal research with normative juridical and sociological approaches, supported by analysis of relevant regulations and field studies at Radio VIS FM Banyuwangi. The findings indicate that the implementation of royalty payment obligations remains at a partial compliance level, despite initiatives for licensing cooperation and a centralized royalty payment mechanism. The main challenges include limitations in the playlist recording and reporting system for royalties, inflexible and unsystematic broadcasting dynamics, and financial pressures due to the shift in media consumption toward digital platforms such as social media. To address these issues, Radio VIS FM Banyuwangi has implemented improvements in the data recording system for each music broadcast and developed broadcasting strategies based on social media digitization. Therefore, the obligation to pay royalties constitutes an imperative legal demand for radio broadcasting institutions as commercial users of musical works, requiring effective synergy among broadcasters, the National Collective Management Institution (LMKN), and the Indonesian Broadcasting Commission (KPI) to strengthen oversight mechanisms and royalty compliance in support of copyright protection.
