Abstract
Inheritance laws are a key component of the general regulatory framework governing the transfer of individual inheritances. In Indonesia, inheritance provisions are regulated by the Civil Code and various other applicable regulations and guidelines, including standard regulations and Islamic laws applicable within specific networks. The study is motivated by the existence of Timorese customary law, which predominantly adheres to a patrilineal system. In this tradition, sons are regarded as the main heirs and successors of the family line, while daughters are often placed in a disadvantaged position in terms of inheritance rights The purpose of this research is to examine the practice of inheritance distribution in Kuanino Village, to analyze the position of daughters within this customary inheritance system, and to identify the influencing factors in its implementation. The research employs a juridical-sociological approach, with data collected through interviews, observation, and literature study.The findings reveal that inheritance distribution in Kuanino Village is still strongly influenced by patrilineal values. Sons generally receive the main share of the inheritance, while daughters usually do not inherit directly. Instead, they are often given property in the form of parental gifts at the time of marriage (belis or dowry-related assets). However, there is an emerging shift within parts of the community, which has begun to allocate inheritance to daughters as a form of justice and adaptation to national legal principles as well as gender equality values.The study concludes that the customary inheritance system in Kuanino Village still places daughters in a weaker position. Nevertheless, there are growing opportunities for change toward a fairer distribution pattern, influenced by national law and rising community awareness of the importance of equal rights
