PENERAPAN PRINSIP DIFERENSIASI FUNGSIONAL TERHADAP KEWENANGAN PENYIDIKAN DALAM TINDAK PIDANA NARKOTIKA SETELAH BERLAKUNYA KUHAP BARU

This study examines the application of the principle of functional differentiation to investigative authority in narcotics crimes following the enactment of the new Criminal Procedure Code (KUHAP). This study aims to analyze the application of the principle of functional differentiation to investigative authority in narcotics crimes following the enactment of the new KUHAP, as well as to examine the coordination relationship between National Police. investigators and National Narcotics Agency (BNN) investigators. The research method used is normative legal research with a statutory and conceptual approach. Legal materials were obtained through a literature review of relevant laws and regulations, doctrines, scientific journals, and legal literature, and then analyzed qualitatively. The results indicate that normatively, investigative authority in narcotics crimes remains based
on Law Number 35 of 2009 concerning Narcotics as lex specialis, while the new KUHAP emphasizes the principle of coordination and more structured investigative governance.
