Abstract
Child trafficking is a serious crime that threatens the future of the nation's generations. One of the most common methods used is illegal adoption, the practice of adopting a child without proper legal procedures and potentially making the child the object of the transaction. This study examines criminal liability for child trafficking using adoption as a method in Dolopo Village, Dolopo District, Madiun Regency, which is largely still carried out based on customary practices without reference to the Child Protection Law or Government Regulation Number 54 of 2007 concerning the Implementation of Child Adoption. The purpose of this study was to determine the methods used by perpetrators in adoption practices and to analyze the forms of criminal liability that could be imposed. The method used was sociological juridical through interviews with village officials and the Social Services Department, as well as literature review, followed by descriptive qualitative analysis. The results showed that adoption practices in Dolopo Village were conducted verbally between families, with the payment of money as a token of gratitude, potentially meeting the elements of human trafficking. Criminal liability can be imposed under Law Number 21 of 2007 concerning the Eradication of Human Trafficking and the Child Protection Law. In conclusion, illegal adoption practices create opportunities for child trafficking, necessitating stricter supervision, outreach, and law enforcement.
