Abstract
This study aims to analyze the implementation of credit agreements between debtor customers and Bank BRI Malang Martadinata Branch as the creditor, as well as to examine the application of the principle of good faith within the credit agreement process. The research method used is empirical juridical research with a descriptive-analytical approach through literature studies and interviews with the bank and debtor customers. The results of the study indicate that the implementation of credit agreements at Bank BRI Malang Martadinata Branch is carried out through several stages, namely submitting a credit application, conducting a feasibility analysis of the prospective debtor, signing the credit agreement, as well as the disbursement of credit and supervision of installment payments. All of these stages comply with banking standard operating procedures and applicable contract law provisions. Furthermore, the application of the principle of good faith in credit agreements is reflected through transparency regarding the rights and obligations of the parties, the debtor’s honesty in providing personal data and financial condition, as well as the bank’s professional conduct in performing credit analysis, determining fees, and providing explanations regarding credit risks. However, this study also finds that, in practice, there is still potential for inequality between the parties, thus requiring efforts to enhance transparency and legal protection for debtors to ensure the optimal fulfillment of the principle of good faith.
