PERLINDUNGAN HUKUM TERHADAP PIHAK- PIHAK DALAM TRANSAKSI JUAL BELI LELANG DI MEDIA SOSIAL INSTAGRAM

This study aims to examine the forms of legal protection available to participants and organizers of auctions conducted through buying and selling transactions on the social media platform Instagram. The research adopts a normative juridical approach, analyzing provisions within the Indonesian Civil Code (KUHPerdata), the Electronic Information and Transactions Law (ITE Law), legal protection concepts, and principles of contract law. The results indicate that legal protection for parties involved may be implemented both preventively and repressively. Preventive legal protection for auction participants on Instagram is provided through clear information, good faith, and valid agreements to prevent disputes, while repressive protection is granted through the right to demand contract annulment or compensation for breach of contract (wanprestasi) based on the Civil Code and supported by digital evidence in accordance with the ITE Law.Sellers or auction organizers obtain preventive legal protection by binding participants through valid agreements to avoid potential losses, and repressive protection through the right to claim compensation, annul contracts, and pursue dispute resolution through either litigation or non-litigation channels.This study emphasizes the importance of specific legislation governing auction practices on social media platforms in order to create legal certainty and protect the rights of all parties involved.
