Abstract

Drug abuse is a serious problem that affects health, social conditions, and the legal system. In Indonesian criminal law, drug abusers and addicts are generally regarded as victims who are required to undergo medical and social rehabilitation as regulated in Law Number 35 of 2009 on Narcotics. However, in law enforcement practice, imprisonment is still more frequently imposed than rehabilitation. This situation has resulted in ineffective recovery for drug addicts and an increasing number of narcotics inmates in correctional institutions. This study aims to analyze the effectiveness of imprisonment in rehabilitating drug addicts at the Class IIB Bondowoso Correctional Institution and to identify the factors that hinder its effectiveness. This research uses a sociological juridical legal research method with a qualitative approach. Research data were obtained through interviews with correctional officers at the Class IIB Bondowoso Correctional Institution and literature studies of relevant laws and legal references. The results of this study indicate that imprisonment has not been effective in rehabilitating drug addicts at the Class IIB Bondowoso Correctional Institution. The correctional programs implemented are still general and focus mainly on religious, moral, and self-reliance development, while medical and social rehabilitation have not been optimally implemented. The inhibiting factors include overlapping legal regulations between imprisonment and rehabilitation, limited facilities and infrastructure, an imbalance between the number of officers and inmates, the lack of optimal cooperation with the National Narcotics Agency, and prison overcapacity. Based on these findings, it can be concluded that sentencing for drug addicts should be directed toward a more comprehensive rehabilitative approach. Medical and social rehabilitation should be prioritized over imprisonment in order to achieve the objectives of punishment, particularly recovery and social reintegration.
