PEMENUHAN KEADILAN BAGI KORBAN PADA PUTUSAN BEBAS TINDAK PIDANA PERDAGANGAN ORANG: STUDI ATAS PUTUSAN NOMOR 555/PID.SUS/2023/PN STABAT

This research is motivated by the viral case of “Human Cage which dragged the name of the Former Regent of Langkat, Terbit Rencana Perangin-angin in the case of the Crime of Human Trafficking which was acquitted by the Stabat District Court in Decision Number 555/Pid.Sus/2023/PN. Stabat as regulated in Law Number 21 of 2007 and the imact of the acquittal on the fulfillment of justice for the victim. The formulation of the roblems raised in this research includes; (2) How are the prinsiples of justice for victims fulfilled in case of criminal acts of Human Trafficking in Decision Number 555/Pid.Sus/2023/PN.Stabat? This research uses a normative juridical method where the method focuses on the study of written legal norms, legal principles, and statutory regulations relevant to the issue under study, namely the acquittal in the case of the criminal act of trafficking in persons, Decision Number 555/Pid.Sus/2023/PN.Stabat. This decision is controversial because it does not reflect justice for victims who experience
exploitation, physical and physical violence, as well as economic losses. The results of this research show that the judge's considerations in handing down an acquittal decision in this case emphasized the unclear construction of the criminal incident, the inconsistency of witness statements, and the failure to fulfill the elements required in Law Number 21 of 2007 concerning the Eradication of the Crime of Trafficking in Persons and with these results the application of the principle of achieving justice for victims
was not reflected in the decision because the judicial process and the verdict did not show any efforts to restore, protect or fulfill the victims' rights.
