Abstract

Diversion in Law No. 11 of 2012 concerning the Criminal Justice System for Children is a method of resolving cases involving children in conflict with the law outside of the criminal justice process. The Batu District Attorney's Office, as one of the agencies involved in the prosecution stage, has a role in implementing diversion to protect children and act in their best interests. This study discusses the formulation of the problem regarding the effectiveness of the diversion at the prosecution stage, as well as the factors influencing the implementation of diversion for children in conflict with the law at the Batu District Attorney's Office. The research method used is empirical juridical research with primary data obtained from interviews with Mr. M. Wildan Hakim, S.H. The study's results show that there are three indicators of the effectiveness of diversion implementation at the prosecution stage of the Batu District Attorney's Office. First, the level of public compliance with the law. Second, the rate of legal case resolution. Third, the rate of decline in the number of legal violations. There are two main obstacles to implementing diversion at the prosecution stage at the Batu District Attorney's Office. First, the law enforcement factor. Second, the community factor. Meanwhile, the supporting factors in the implementation of diversion comprise
three aspects: the legal factor, the facilities and infrastructure factor, and the cultural factor. The study concludes that the diversion program implemented at the prosecution stage at the Batu District Attorney's Office is ineffective in reducing the number of cases involving children in conflict with the law in the Batu City area. It is recommended that the Batu District Attorney's Office improve the competence and capabilities of juvenile prosecutors and provide intensive, continuous legal education for the community.
