Abstract

This study aims to analyze judicial reasoning in Decision Number 454/Pid.B/2024/PN.Sby in the case of Gregorius Ronald Tannur through a normative juridical review, examined from the perspective of the Code of Ethics and Guidelines for Judicial Conduct as well as the fair trial principle. This research employs normative legal research using statutory and case approaches. The legal materials consist of primary, secondary, and tertiary sources, which are analyzed qualitatively. The findings indicate that although the criminal justice process in the a quo case was conducted in accordance with criminal procedural law, the judicial reasoning applied in rendering the decision tends to emphasize formal procedural aspects. The protection of the defendant’s rights was fulfilled through the application of the presumption of innocence and the provision of adequate legal defense. However, the assessment of evidence representing the victim’s interests, including CCTV recordings, witness testimonies, and visum et repertum, was not carried out optimally. From the perspective of Gustav Radbruch’s theory of substantive justice, this condition demonstrates that the balance between legal certainty and justice has not been fully achieved, resulting in a decision that has not yet fully reflected substantive justice.
