Abstract
This research examines the legal implications of therapeutic agreements between aesthetic doctors and patients from the perspective of civil law. The background of the study arises from the rapid growth of the beauty industry in Indonesia, which creates a demand for legal certainty and patient protection. A therapeutic agreement is understood as a contractual relationship born from the consent between doctor and patient, and it is subject to the principles of contract law under the Indonesian Civil Code (KUHPerdata), namely the principles of consensualism, freedom of contract, good faith, and balance. The research method applied is normative juridical with statutory and conceptual approaches, supported by analysis of relevant court decisions. The findings show that the application of contract law principles in aesthetic practice often encounters an imbalance of legal positions between doctors and patients. Patients are in a vulnerable condition due to limited understanding of medical risks, making the principles of balance and good faith essential to ensure legal protection. Furthermore, health law norms through the Civil Code, the Medical Practice Act, the Health Act, the Ministry of Health Regulation on Clinics, and the Indonesian Medical Code of Ethics emphasize the legal position and responsibilities of doctors. Doctors are required to possess competence, valid practice licenses, and to carry out procedures in accordance with professional standards. In cases of violation, doctors may be held liable under civil, criminal, or administrative law. Thus, this study affirms that therapeutic agreements in aesthetic practice are not merely formal documents but serve as accountability instruments that guarantee legal certainty for medical professionals and protection for patients.
