Abstract

This study examines the law enforcement process against illegal levies committed by the Sawoo Village Government during the implementation of the Complete Systematic Land Registration Program (PTSL) in Ponorogo Regency. Normatively, PTSL aims to accelerate land certification through procedures that are affordable, transparent, and accountable; however, empirical findings reveal deviations in the form of unauthorized land-sealing fees that lacked legal basis, were coercive in nature, and varied across residents. Employing an empirical juridical approach through interviews, field observations, and document analysis, this research identifies the types of illegal levies, evaluates the resolution mechanisms, and analyzes the decision of the Corruption Court (TIPIKOR). The findings show that illegal levies were carried out systematically by certain village officials who abused their authority by imposing fees contrary to Ministerial Regulation ATR/BPN No. 6 of 2018. These practices imposed financial burdens on residents, eroded public trust, and deviated from the principles of good governance. The handling of the case by the Ponorogo District Prosecutor’s Office—through verification, clarification, investigation, and the submission of the case to TIPIKOR, which ultimately rendered a decision based on Article 11 of the Anti-Corruption Law—demonstrates the effectiveness of external oversight and the upholding of the rule of law. This study affirms that effective law enforcement against illegal levies depends on the integrity of public officials, transparency in land administration, and the functionality of external supervisory mechanisms. The findings contribute to agrarian law development, village governance reform, and socio-legal scholarship, and provide strategic recommendations for ensuring a corruption-free PTSL implementation that guarantees legal certainty for the community.
