Abstract
This research aims to identify the forms of broadcasting violations of soap operas
carried out without permission on the TikTok platform, as well as to examine the forms of legal protection that can be provided to copyright holders for unauthorized broadcasting on TikTok. The method used in this research is normative legal research with statue approach, conseptual, and case approach. The results of this research indicate that the violation consists of uploading clips and broadcasting soap operas via live streaming without permission through the TikTok platform. These actions violate Article 9 Paragraph (1) Letter g of Law Number 28 of 2014 concerning Copyright and Article 32 of Law Number 11 of 2008 concerning Electronic Information and Transactions, as amended by Law Number 19 of 2016. The forms of legal protection against broadcasting violations preventive protection involves registering the copyrighted with the government, and the government monitors the creation and distribution of content that infringes copyright. TikTok also provides preventive protection in the form of policies that regulate the use of copyrighted works on TikTok, offering an option to report content deemed to violate regulations. Meanwhile repressive protection is in the civil context by resolving disputes through the Commercial Court in addition it can also claim compensation for the losses that have been suffered. Violators can be subject to sanctions in accordance with the Article 113 of the Copyright Law and may be prosecuted under Article 48 of the Electronic Information and Transactions Law.
