ANALISIS YURIDIS NORMATIF PENGGUNAAN ARTIFICAL INTELLIGENCE (KECERDASAN BUATAN) DALAM PENCIPTAAN KARYA GAMBAR BERDASARKAN UNDANG-UNDANG HAK CIPTA DI INDONESIA

This study discusses intellectual property rights (IPR) over works produced by Artificial Intelligence (AI). As technology advances, increasingly sophisticated AI has led to the creation of creative works that resemble those produced by humans. However, based on the legal system in Indonesia, namely Law Number 28 of 2014 concerning Copyright, there are no clear regulations regarding the legal status of AIbased works. The main issue examined in this paper is to identify theapplicable legal regulations and the legal position of AI works from an IPR perspective. The research method used is normative juridical by examining national legislation and reviewing several literature. In the Indonesian legal system, the principle of human authorship, where the creator is an individual who produces unique and personal works, is still applied, which indicates a legal vacuum. It is difficult to prove the causal relationship between human actions and AI's automatic output, and the inability of AI as a legal subject to bear legal responsibility is a major problem. Therefore, appropriate suggestions in the research results that are significant in the creative process, especially copyright, will continue to develop, and it is hoped that Indonesia will be able to keep up with technological developments.
