Abstract
This study focuses on the utilization of Regional Property in Blitar City as regulated by Blitar City Regional Regulation Number 2 of 2019 concerning the Management of Regional Property. The purpose of this study is to analyze the legal provisions governing the utilization of Regional Property and to evaluate the effectiveness of their implementation in supporting the increase of Regional Original Revenue. The research method employed is a juridical-empirical approach, conducted through the study of relevant laws and regulations and the collection of empirical data through interviews with officials of the Regional Financial and Asset Management Agency (BPKAD) of Blitar City. The results of the study indicate that although Article 29 Blitar City Regional Regulation Number 2 of 2019 has comprehensively regulated the utilization of Regional Property, its implementation has not been effective. This condition is caused by the continued reliance on Government Regulation Number 27 of 2014 concerning the Management of State/Regional Property and Minister of Home Affairs Regulation Number 19 of 2016 concerning Guidelines for the Management of Regional Property as the main references, limited competence of government officials in the asset appraisal process and contract drafting, limited support from the Regional Property Management Information System, the utilization of government assets by the community, and the low level of public understanding regarding the legal status of government-owned assets. These conditions result in obstacles in the form of regulatory irrelevance, weaknesses in cooperation agreements for the utilization of Regional Property, and weak supervision of contract implementation. The conclusion of this study shows that the implementation of Blitar City Regional Regulation Number 2 of 2019 in the utilization of Regional Property has not been effective and has caused various obstacles in the utilization of Regional Property. Therefore, it is necessary to optimize SIMBADA to ensure orderly administration, utilize the official BPKAD website as a means of supervision and information transparency in the management of Regional Property, update regulations, improve the capacity of government officials, and ensure that cooperation in the utilization of Regional Property is supported by written contracts in accordance with the principles of contract law in order to achieve legal certainty and effective regional asset management.
