Abstract

Diversion is a mechanism for resolving juvenile cases outside of court, as mandated by Law No. 11 of 2012 on the Juvenile Criminal Justice System. Although it is clearly regulated, the implementation of diversion at the prosecution level still faces various obstacles. This study raises the issue of how prosecutors consider diversion in cases of abuse by children, as well as the obstacles and solutions encountered in its implementation at the Batu District Attorney's Office. This study uses an empirical juridical method with the research location at the Batu District Attorney's Office. Data was obtained through interviews with the Child Prosecutor, direct observation, and case file document studies. Data analysis was conducted using descriptive qualitative methods to describe the actual practice of diversion in the field.
The results of this study conclude that although diversion is clearly regulated normatively, its implementation has not been optimal due to constraints such as public understanding, limited resources, and the complexity of psychological dynamics in abuse cases. Comprehensive efforts are needed in the form of continuous public outreach, strengthening the competence of prosecutors, and improving the coordination system between institutions to increase the success of diversion as a form of restorative justice in the juvenile criminal justice system.
