Abstract
Traffic violations by children remain a serious problem in Malang City because they have the potential to endanger the safety of children and other road users. Children are not yet fully mature in understanding the risks and legal responsibilities in traffic, but in practice many are still involved in traffic violations. This study examines two main problems, namely (1) factors that influence the occurrence of traffic violations by children and (2) legal settlements for children who commit traffic violations in the Malang City Police area. The purpose of this study is to analyze the factors causing traffic violations by children and examine the form of legal settlement based on the level of violation committed. The research method used is empirical research with a sociological juridical approach. Research data were obtained through interviews with police officers and a review of official documents related to the handling of traffic violations by children, then analyzed qualitatively. The results of the study indicate that traffic violations by children are influenced by internal factors, such as permissive attitudes, subjective environmental norms, and perceptions of self-control, as well as external factors such as lack of family supervision, weak school roles, and the influence of social circles. Case resolution is carried out based on the level of violation, namely guidance and education for minor violations, trials if diversion is unsuccessful for moderate violations, and formal legal processes for serious violations while still prioritizing the principles of child protection and restorative justice. This research has an element of novelty because it examines the resolution of violations based on the classification of the level of violation in the midst of the absence of clear regulations regarding the category of moderate violations in Law Number 22 of 2009, so that its handling in practice is highly dependent on police discretion and requires clearer regulations to ensure legal certainty and child protection.
