Abstract
Restorative Justice as an approach to resolving criminal cases at the prosecutor's office focuses on restoring the relationship between the perpetrator and the victim, especially in cases of minor crimes such as assault. This study aims to analyze the considerations of the Public Prosecutor in determining the suitability of assault cases to be resolved through Restorative Justice and to assess the effectiveness of its implementation at the Malang City Prosecutor's Office. The method used is empirical juridical with a regulatory approach and field studies through interviews with prosecutors, supported by primary and secondary legal materials. The results of the study show that the prosecutor's considerations are based on Attorney General Regulation Number 15 of 2020, which assesses the criminal threat, the victim's losses, the perpetrator's background and motives, and the existence of a voluntary peace agreement. In practice, Restorative Justice is able to resolve minor assault cases quickly, simply, and fairly without having to proceed to trial. This mechanism also reduces the caseload, strengthens the role of prosecutors as facilitators, and provides space for recovery for victims and responsibility for perpetrators. The conclusion drawn from the study shows that the application of Restorative Justice at the Malang City Prosecutor's Office is considered effective in handling minor assault cases. Recommendations that can be made include improving the quality of peace facilitation, strengthening coordination between law enforcement officials, and conducting ongoing outreach to the community to ensure the consistency and sustainability of Restorative Justice as an effort to build substantive justice oriented toward continuous mutual recovery.
