Abstract
Land Deed Officials (PPAT) have authority from the state to legalize legal actions related to land through authentic deeds. However, legal complications often arise when Land Deed Officials become entangled in disputes caused by actions outside their authority. Therefore, this study aims to analyze civil cases in Decision Number 75/Pdt/2016/PT.Dps. The research method used is normative juridical with a legislative approach and a case approach. There are also problem formulations for discussion in this study. First. How did the judge analyze the considerations related to the dispute over breach of contract in the sale and purchase of land in the first instance court decision number 499/Pdt.G/2015/PN/Dps. And the high court decision number 75/Pdt/2016/PT.Dps? Second, what are the elements of unlawful acts and breach of contract by the PPAT (Land Deed Official) for his involvement in case number 75/Pdt/2016/PT.Dps? The results of the discussion in the study found that the basis for the judge's consideration in finding the PPAT guilty was that they were proven to have committed a breach of contract by failing to return the deposit after the agreement was canceled, as well as committing an unlawful act due to violating the principle of propriety of public officials. The verdict ordered the defendants to pay material and immaterial damages, so this study recommends strengthening regulations related to the limits of responsibility of Land Deed Officials (PPAT) in handling third-party funds and strict supervision of professional operational standards to ensure legal certainty and protection for the community.
