Abstract

Divorce in Indonesia is strictly regulated by law. Based on Article 39 paragraph 1 of Law Number 1 of 1974 concerning Marriage, divorce can only be conducted before a court hearing after the relevant court has attempted but failed to reconcile both parties. This study aims to examine and analyze the implementation of divorce petition settlement in Case Number 4996/Pdt.G/2025/PA.Kab.Malang. This research is an empirical legal study employing a socio-legal approach. The research findings indicate that the implementation of the petition settlement has been in accordance with applicable civil procedural law. The discussion reveals that the petition was granted based on the fulfillment of Article 116 letter (f) of the Compilation of Islamic Law regarding continuous disputes between spouses. Based on these findings, it can be concluded that parties intending to file a divorce petition need to understand the court proceedings comprehensively so that case resolution can proceed smoothly without significant obstacles
