Abstract
This research aims to analyze the effectiveness of the implementation of regulations governing the distance radius for the establishment of modern shopping centers in protecting the existence of Dinoyo Traditional Market and ensuring fair and healthy business competition, as well as to identify the inhibiting factors faced by the Malang City Office of Industry and Trade in their implementation and the implications for the effectiveness of supervision and policy enforcement. This study employs an empirical legal research method with a socio-legal approach through field research conducted by interviews and observations, supported by secondary data in the form of statutory regulations and relevant literature, which are analyzed qualitatively. The results indicate that the implementation of regulations on the distance radius of modern shopping centers has not been effective due to unclear technical provisions, weak supervisory mechanisms, and suboptimal coordination among relevant institutions. The discussion reveals that these obstacles reduce the level of protection for traditional markets and hinder the realization of fair business competition. Therefore, this research recommends the clarification of quantitative technical regulations, the strengthening of the supervisory role of the Office of Industry and Trade, and the enhancement of institutional coordination to ensure consistent implementation and provide legal certainty and protection for traditional markets.
