Abstract

The employment relationship between employers and casual daily workers in Indonesian labor practice continues to raise legal issues, particularly in determining employment status under Fixed-Term Employment Agreements (PKWT) based on the time period. The absence of clear criteria for classifying casual daily workers may result in legal uncertainty and weaken the protection of workers’ rights. This study aims to analyze judges’ legal considerations in Decision Number 8/Pdt.Sus/2020/PN.Ptk concerning the determination of casual daily worker status and its legal implications for the plaintiffs’ employment relationship. This research employs a normative legal method using statutory and conceptual approaches. The findings indicate that the panel of judges emphasized the element of working fewer than twenty- one days in one month without comprehensively considering the requirement of three consecutive months. Therefore, this study is expected to provide clearer criteria for casual daily workers and serve as a reference for the implementation of labor law that ensures legal certainty.
