Abstract

This study analyzes the rules of human organ trafficking in Indonesia. The method used is normative juridical, with the first topic of discussion being the positive legal regulation in Indonesia against human organ trafficking, then the second is the effectiveness of the application of positive law in providing legal protection for victims of human organ trafficking in Indonesia. Primary data was obtained through literature studies and legal literature derived from laws and regulations, journals, books, and positive legal doctrines. The results of the study show that a legal rule cannot run effectively if it is not supported by professional law enforcement apparatus, then in terms of regulating the substance of the law, there is still minimal regulation regarding the trade of human organs. This study provides recommendations so that the integration of the two can run harmoniously for the sake of creating social order and protecting human rights without ignoring the values of goodwill and individual interests. The recommendation of this study is that lawmakers can regulate more specifically the sale and purchase of organs related to transplantation, as well as add content material regarding legal protection and then the need to make organs or bodies that handle organ transplantation in Indonesia.
