ANALISIS YURIDIS KETIDAKPATUHAN TERGUGAT TERHADAP ISI PUTUSAN PENGADILAN DAN MEKANISME PRA-PELAKSANAAN EKSEKUSI PUTUSAN NOMOR 176/Pdt.G/2024/PN.Kpn MENGENAI PENGOSONGAN OBJEK SENGKETA

Research entitled "Legal Analysis of Defendant's Non-Compliance with the Contents of the and the Pre-Enforcement Mechanism of Judgment Number 176/Pdt.G/2024/PN.Kpn Regarding the Eviction of the Object of Dispute" aims to determine the legal implications of the Defendant's non-compliance with the contents of the court decision that has permanent legal force, as well as to determine the mechanism prior to the execution of the decision in the breach of contract dispute Number 176/Pdt.G/2024/PN.Kpn. This type of research uses an empirical legal method that focuses on the direct application of law by the object of study by observing behavior directly (field research). The results obtained from this study show that when the defendant does not comply with a court decision that has permanent legal force (incracht), it can have serious legal consequences. If the losing party does not voluntarily comply with the contents of the decision, the winning party can file a request for execution of the decision with the District Court. However, failure to comply with the decision can also be categorized as contempt of court. Based on the General Explanation of Law Number 14 of 1985 concerning the Supreme Court, contempt of court is defined as an action, deed, behavior and/or statement that can demean and undermine the authority, dignity and honor of the judiciary. Furthermore, it is also known that the process or stages prior to the execution consist of sending a First Warning Letter and a Second Warning Letter and submitting a Request for Execution of the Decision.
