Abstract
There has been a violation of the provisions of Article 19 paragraph (1) and (2) of Law No. 11 of 2012 concerning the Juvenile Criminal Justice System, particularly in terms of the dissemination of children's identities by the media and law enforcement officers. This phenomenon shows a gap between the ideal law (das sollen) and the legal reality that occurs (das sein), which can have serious
impacts on the future and human rights of children. The purpose of this study is to examine the socio-legal study of children's identity privacy in the juvenile criminal justice system" (Case Study at the Malang Police). This study uses a socio-legal approach with qualitative methods. Data were collected through interviews with various relevant parties, including children in conflict with the law, law enforcement officers at the Malang Police, and journalists who have covered children's cases. In addition, a literature study was also conducted as secondary data. The research location includes the Malang Police, news media (Jawa Pos Radar Malang), and Ngijo Village, Karangploso, Malang Regency. The data analysis technique used is descriptive qualitative. The study shows that
the protection of children's identities in criminal cases is still weak, especially due to violations by the media. Although the law has regulated the prohibition of identity publication, its implementation has not been effective. The main factors include weak supervision, low media awareness, and unclear sanctions. As a result, children and their families experience psychological, social, and economic
pressure.
