Abstract

The neglect of post-divorce economic rights continues to occur due to the failure of former husbands to fulfill alimony obligations as stipulated in the rulings of the Religious Courts. This condition has significant impacts on the economic sustainability and psychological
well being of former wives and children. This study aims to analyz the implementation of the settlement of post-divorce economic rights through a restorative justice approach at the Malang City Police Department. The research employs an empirical juridical method, using primary data obtained through interviews and observations, as well as secondary data derived from statutory regulations and legal literature. The results indicate that the application of restorative justice is carried out through stages including reporting, examination of the parties, mediation, and the withdrawal of complaints, and has proven effective in accelerating the recovery of victims economic rights. The
discussion reveals that the restorative justice approach prioritizes victim recovery over punitive measures; however, in practice, obstacles remain at the stage of implementing the agreements reached. This study emphasizes the need to strengthen supervisory
mechanisms and ensure enforcement by law enforcement authoritirs so that the fulfillment of victims post-divorce economic rights does not rely solely on the good faith of the reported parties.
