Abstract
Boundary determination is an essential stage in land registration to ensure legal certainty of land ownership rights. This study aims to analyze the effectiveness of implementing the Contradictoire Delimitatie principle in boundary determination at the Madiun City Land Office. The research applies an empirical juridical method using literature studies and in-depth interviews with officials and survey officers of the Land Office. The results indicate that the Contradictoire Delimitatie principle has been effectively implemented from legal and administrative perspectives, as it fully complies with the formal requirements set forth in Ministerial Regulation Permen ATR/BPN Number 16 of 2021, particularly through written consent mechanisms and geotagged photo documentation. This principle strengthens the legal foundation of land certificates and functions preventively in minimizing boundary disputes among landowners. However, its effectiveness remains limited by several obstacles, including the absence of parties during field measurements, low public awareness in installing boundary markers, weak administrative supervision, and structural issues at the sub-district level. The Madiun City Land Office has made efforts such as adopting geotagging technology, requiring written approval prior to measurement, and enhancing coordination with local officials. The study recommends strengthening public legal education and administrative monitoring to ensure that the Contradictoire Delimitatie principle is applied more consistently, effectively and equitably.
