Abstract

In this study, the author examines the evidentiary value of police witness statements used as evidence in narcotics criminal cases, using Case No. 90/Pid.Sus/2025/PN Mlg as a case study. This study uses empirical legal research with a case approach. The legal materials used in this study are primary data, secondary data, and tertiary data with data collection techniques of observation, documentation, and data analysis. The results of this study show that the probative value of police witness testimony used as evidence in court is not strong; a witness must be truly independent, impartial, objective, and honest. (Explanation of Article 185 paragraph (6) of the Criminal Procedure Code). Supreme Court Case No. 1531/K/Pid.Sus/2010 has reinforced the guideline that police witnesses have a vested interest in ensuring that the cases they handle are successful in court. Therefore, according to the author, there are no factual witnesses who know about the defendant's drug abuse. Witnesses are a very important piece of evidence in uncovering the criminal behavior alleged against the defendant, where investigators who testify at trial, as stipulated in Article 1 point 26 of the Criminal Procedure Code, define a witness as a person who can provide information for the purposes of investigation, prosecution, and adjudication of a criminal case that they themselves have seen and experienced.
