Abstract

The rapid development of the real estate and property development sector often gives rise to legal issues that extend to the area of criminal law, particularly in relation to fraud and consumer losses. The resolution of criminal cases through formal judicial mechanisms often fails to provide optimal compensation for victims. Therefore, restorative justice-based penal mediation has become an alternative means of resolving cases that is beginning to be applied in law enforcement practice. This research aims to analyze the process of mediation in the settlement of criminal cases in the field of property development and to examine the role and position of advocates in supporting the effectiveness of mediation. The research method used is empirical legal research with a descriptive qualitative approach. This data was obtained through observation, interviews, and documentation conducted at the Lesanpuro Law Firm and Malang Police Department. The research results show that penal mediation can be an effective means of resolving criminal cases, particularly in the recovery of compensation for victims of housing crimes. The lawyer's role is very significant, not only as a legal assistant in the investigation process, but also as a facilitator and negotiator in the mediation process. The combination of criminal law, professional ethics, and penal mediation has successfully encouraged fair settlements. Therefore, penal mediation is a relevant and useful solution for criminal cases involving property development
