Abstract

Legislation imposes heavier penalties through the concept of continuing offenses to strengthen child protection and deter perpetrators. This study examines the case resolution process and the panel of judges’ legal considerations regarding the continuing crime of sexual abuse of minors committed by Heri. This study aims to identify and analyze the criminal case settlement process and examine the legal considerations of the panel of judges in applying continuing criminal acts of molestation of minors. The research method used is empirical juridical, analyzing the applicable legal provisions in relation to the realty in the field. The researcher used primary data, namely the results of observations at the Kepanjen District Court and case files at the Didik Lestariyono and Associates Law Office, as well as secondary data, namely Law Number 35 of 2014 concerning Amendments to Law Number 23 of 2002 concerning Child Protection, Law Number 17 of 2016 concerning the Stipulation of Perpu Number 1 of 2016 concerning the Second Amendment to Law Number 23 of 2002 concerning Child Protection into Law and Law Number 1 of 1945 concerning the Criminal Code. This study shows that the Panel of Judges at the Kepanjen District Court was correct in deciding on the continuing criminal act of sexual abuse of a minor againt Heri. In its legal considerations, the Panel of Judges Provided a more comprehensive confirmation regarding the application of continuing acts.
