Abstract

The issue of one person having two different names in their identity documents formed the basis for a dispute over the annulment of a decision in the Malang District Court. The author of this paper aims to examine the court proceedings in the case of the annulment of a decision concerning a person with two names in Case Number: 51/Pdt.G/2025/PN.Mlg. The research method used is empirical juridical, with legal data collection techniques through direct observation of the trial proceedings and assisting the defendant's legal counsel during the case examination process. The trial process began with the registration of the lawsuit for the annulment of the decision at the Malang District Court, followed by mediation, which did not reach an agreement, the reading of the lawsuit by the plaintiff, the defendant's response, the reply and rejoinder, and the presentation of evidence in the form of documents and witnesses, ending with the reading of the panel of judges' decision. This dispute originated from a previous court decision that declared two different names to be the same person, but was then challenged by the party who felt aggrieved, namely the Plaintiff. The settlement process of this case has been carried out in accordance with applicable civil procedural law, whereby the judge considers administrative evidence and legal facts in order to uphold the principles of legal certainty, justice, and benefit. It is hoped that this study can provide an understanding of the importance of a person's identity in population administration and the role of the court in ensuring the protection of citizens' civil rights.
