Abstract

Determining the absolute competence of a court is a fundamental aspect of civil procedural law because it determines the validity of the examination and decision process. In practice, lawsuits often mix disputed objects across jurisdictions, resulting in exceptions to absolute competence and resulting in interlocutory decisions. This error not only hinders dispute resolution but also has the potential to result in legally flawed decisions. This study aims to analyze the settlement of cases and identify obstacles in Interlocutory Decision Number 207/Pdt.G/2024/PN.Kpn related to the exception of absolute competence. The research method used is empirical juridical with primary and secondary data sources. Primary data was obtained through direct observation of the trial process and analysis of case documents, including the lawsuit, amendments to the lawsuit, the parties' responses, and the interlocutory decision. Secondary data was obtained through a literature review covering laws and regulations, legal doctrine, as well as scientific literature and journals in the field of civil procedural law. The research object focused on the analysis of interlocutory decisions and the case resolution process at the Kepanjen District Court. The result of the discussion was that the exception of absolute authority submitted by the Defendant was granted, so that the Kepanjen District Court was declared not authorized to adjudicate the a quo case because the substance of the dispute was related to the validity or otherwise of the marriage of the Muslim parties, which is the absolute authority of the Religious Court as regulated in Article 49 of Law Number 3 of 2006. The main obstacle in this case lies in the Plaintiff's inaccuracy in formulating the lawsuit, especially in determining the absolute competence of the competent court. Thus, a proper understanding of absolute competence is an important prerequisite in filing a civil lawsuit in order to realize an effective and efficient judicial process.
