PENYELESAIAN SENGKETA WARIS DI PENGADILAN NEGERI KOTA MALANG (STUDI KASUS PERKARA NOMOR 190/PDT.G/2025/PN.MLG)

The settlement of civil inheritance cases in district courts often leads to prolonged conflicts due to differences in interests among heirs who are related. The litigation process tends to be time-consuming and costly, and has the potential to exacerbate conflicts, thus requiring a more effective, efficient, and fair alternative dispute resolution mechanism in court. Mediation, as part of the civil justice system regulated in Supreme Court Regulation No. 1 of 2016, is an effort to achieve peaceful dispute resolution. This study aims to analyze the process of settling civil inheritance cases in the District Court by assessing the effectiveness of mediation in settling such cases and analyzing the provisions of the settlement agreement as the final decision in the settlement of cases according to civil law provisions. The research method used is empirical juridical through a case study of Case Number 190/Pdt.G/2025/PN.Mlg with data collection techniques through observation interviews and documentation. The results of the study show that mediation plays a strategic role in accelerating the settlement of inheritance cases and maintaining harmonious family relationships between the parties. Mediation in court plays an important role in resolving civil inheritance disputes because it prioritizes deliberation and consensus with the help of a neutral mediator. The agreement reached through mediation is outlined in a legally binding settlement agreement, thereby providing legal certainty for the parties. Therefore, optimizing the role of mediators and increasing public legal awareness are important factors in the success of inheritance mediation.
