PROSEDUR PENGAJUAN GUGATAN TERHADAP AKTA PERDAMAIAN NOTARIS YANG BERTENTANGAN DENGAN HUKUM (STUDI KASUS PERKARA NOMOR 158/PDT.G/2025/PN.MLG)

The essence of a settlement agreement lies in the existence of an agreement to end the dispute between the two parties. However, in practice, it is not uncommon to find that settlement agreements that have been drafted and ratified contain provisions that contradict applicable laws. The purpose of this study is to determine how the procedure for filing a lawsuit is implemented. This study is an empirical study, or field research, which examines the applicable legal provisions and what actually happens in society. In this study, the issue discussed relates to the implementation of the procedure for filing a lawsuit to cancel a settlement agreement. The process of filing a lawsuit to cancel the settlement agreement in this case began with the preparation of a power of attorney. After the power of attorney was prepared, the next step was to prepare the lawsuit in accordance with the rules set forth in the HIR and RBg, specifically Article 142 of the RBg and article 118 of HIR, which requires that the lawsuit contain the identities of the parties, the facts, legal basis, and petitum clearly and in detail. After the lawsuit is drafted, it is registered through the e-Court system by uploading the lawsuit documents and power of attorney. Once the court clerk's office has declared the lawsuit documents to be complete and valid, the next step is to assign a case number as a sign of the official registration of the lawsuit.
