PROSEDUR HUKUM DALAM PENGAJUAN PENGADUAN PELANGGARAN KODE ETIK ADVOKAT DI DEWAN KEHORMATAN PERADI KOTA MALANG

Violations of the advocate’s code of ethics constitute an issue that directly causes losses to clients and may reduce public trust in the advocate profession. Therefore, an effective mechanism for submitting complaints and enforcing the code of ethics through the Honorary Council, as the authorized institution, is required to address such violations. This research aims to examine the legal procedures for submitting complaints regarding violations of the advocate’s code of ethics at the Honorary Council of PERADI in Malang City. The research employs an empirical legal research method with a sociological juridical approach. The data were obtained through document studies of case files and relevant laws and regulations, as well as direct observation of the process of submitting and examining complaints concerning violations of the advocate’s code of ethics. The results of the study indicate that, in principle, the procedures for submitting complaints regarding violations of the advocate’s code of ethics have been implemented in accordance with applicable regulations. However, in practice, several obstacles remain, particularly during the examination stage and the in-depth analysis of the case chronology, which result in delays in the resolution of complaints. Furthermore, the understanding of the substantive aspects of the case has not been fully optimal, thereby affecting the effectiveness of the enforcement of the advocate’s code of ethics.
