Abstract
Mediation is a mandatory stage in the settlement of civil cases in court, which aims to encourage the peaceful, simple, quick, and inexpensive resolution of disputes. This paper aims to analyze the implementation and effectiveness of mediation in a case concerning the cancellation of a decision on the determination of the name of the same person in Case Number 51/Pdt.G/2025/PN Mlg at the Malang District Court. The research method used is empirical legal research with an empirical juridical approach, supported by primary data through interviews and observations, as well as secondary data in the form of laws and regulations and legal literature. The results of this paper show that mediation has been carried out in accordance with the provisions of Supreme Court Regulation Number 1 of 2016 concerning Mediation Procedures in Court, starting from the appointment of mediators to the reporting of mediation results. However, based on the mediation report, the mediation process in the case in question was declared unsuccessful (failed) because the parties did not reach a settlement agreement. However, the effectiveness of mediation in the case in question was not optimal because the characteristics of the case emphasized certainty of identity and legal certainty, thereby limiting the parties' room for compromise. This discussion emphasizes that the success of mediation is not only determined by the procedures and the role of the mediator, but also by the good faith of the parties and the suitability of the type of case to be resolved through mediation. Therefore, this paper suggests the need to evaluate the application of mediation in certain administrative cases, improve the quality of mediators, and strengthen the parties' understanding of the objectives and benefits of mediation in court.
